Can foreigners buy property in Thailand?
Yes, but with important restrictions. The easiest and most straightforward option for foreigners is to buy a condominium unit under freehold ownership. Foreigners generally cannot own land directly in Thailand, so villas and houses are usually purchased through a leasehold land structure.
What is the difference between freehold and leasehold?
Freehold means the property is registered in your name and you own it outright. It can be sold, gifted, or inherited. For foreigners, freehold ownership is most commonly available for condominium units within the foreign quota. Leasehold means you have the right to use the property for a fixed period, usually up to 30 years, and is often used for villas, houses, and land-related properties.
What is the 49% foreign quota in a condominium?
In each condominium building, foreigners can own up to 49% of the total sellable area. If the foreign quota is already full, the unit cannot be registered under foreign freehold ownership. This is why it is important to check the quota before paying a deposit.
How should I transfer money to buy a condo in Thailand?
For a foreigner buying a freehold condo, the funds are usually transferred from abroad in foreign currency. After the money arrives in Thailand, the bank issues a foreign exchange document, often called an FET. This document is required for registering ownership at the Land Department.
Why is the FET form important?
The FET confirms that the purchase funds were transferred into Thailand from overseas in foreign currency. Without this document, the Land Office may not register a freehold condo in a foreign buyer’s name. It may also be needed later if you sell the property and want to transfer the money back overseas.
Is it safe to buy property through a Thai company?
Buying through a Thai company requires very careful legal review. If the company is created only to bypass foreign land ownership restrictions and the Thai shareholders are only nominees, this can create serious legal risks. For villas and land-related purchases, it is better to discuss the structure with an independent lawyer before signing anything.
What extra costs should I expect when buying property in Thailand?
Besides the property price, buyers should consider registration fees, taxes, sinking fund, monthly maintenance fees, legal fees, and bank charges. The exact amount depends on the property type, deal structure, and agreement between buyer and seller. It is always better to budget for these costs in advance.
Does buying property in Thailand give me a visa or residency?
Buying property in Thailand does not automatically give you a long-term visa, residency, or citizenship. You still need to apply for a suitable visa separately, such as DTV, LTR, Thailand Privilege, retirement visa, or another relevant category. The right option depends on your age, income, lifestyle, and purpose of stay.
Can I rent out my property in Thailand?
Yes, many foreign owners rent out their properties in Thailand. However, it is important to check the rules of the specific condominium, the rental format, and any restrictions on short-term rentals. Investors should look not only at expected rental income, but also at management fees, cleaning, repairs, common fees, and taxes.
What should be checked before buying property in Thailand?
Before buying, it is important to check the title deed, foreign quota, outstanding debts, contract terms, developer reputation, payment schedule, and transfer costs. For villas, you should also check the land title, road access, building permit, and leasehold conditions. The higher the purchase price, the more important proper due diligence becomes.
